I'm currently fighting nausea shopping with my wife in the UW bookstore for a graduation present for my daughter.  I was actually entertained by a customer complaining for 10 minutes with the cashier because whatever ID she used didn't register as tax exempt like she said it should.  This is after the cashier told her she couldn't receive the 25% off everything in the store deal if it did ring up as tax exempt.  She didn't seem to grasp she was getting a better deal. 

Made this trip bearable.

What I don't get is .. why is she "legally negligent"? 

I mean, I get it, you're not supposed to be screwing around (literally) while working, but that's not a criminal act for the court to punish.   

Isn't the captain 100% responsible for, you know, steering the boat, while the "deckhand" is responsible for (insert joke here.)?

I'd draw an analogy to a surgical malpractice case. In a sense, the chief surgeon on the case is totally responsible for the surgery, but that doesn't mean a nurse or anesthesiologist couldn't be sued if they swirled their obligations.
