40,000 is a tad high for commercial flights, which generally operate in the 30,000s.

The other question is where was the balloon when it was shot down. Was it over one of several commercial tracks between the U.S. mainland, Alaska and Asia?

Finally, how stealth was it? If it could not be seen and tracked, the the balloon needed to come down immediately.
