I'm sure your assessment is accurate. My question in response would be - when faced with an aggressor, how does a country win a war against them without committing what are now considered war crimes. In the last war that the US won we and our allies committed what would surely be considered war crimes against our enemies to limit our losses and hasten our enemy's surrender. Wouldn't following codes now in place made WWII much more costly in both blood and treasure?

All very fair, and yes, the US almost surely would have been considered for war crimes. What would/did possibly save us, is when there were public cases (e.g. Abu Ghraib, and a considerable number of murders/rapes), they were charged and sentenced to lengthy prison terms. It made it look like the US policed itself, which has historically been an argument against charging western nations.

Israel isn't policing itself, instead there were calls by major military leaders/government officials to commit what would be considered more crimes. And in cases where there were documented issues (e.g. military facilitating settler violence, and cases of murder/rape), charges were either absent or minimal. That is why the ICC is stepping in.
