A men’s lacrosse player was arrested March 3 on charges of disorderly conduct and obstructing and resisting arrest after allegedly engaging in sexual activity in one of the women’s volleyball locker rooms, according to an incident report from Marquette University Police Department obtained by the Marquette Wire.

MUPD redacted the name of the men’s lacrosse athlete.

A janitor called MUPD at 3:10 a.m. to report the two students allegedly engaging in sexual activity in the women’s volleyball locker room, the incident report stated.

Marquette Athletics spokesperson Scott Kuykendall and Capt. Jeffrey Kranz of MUPD said the incident happened in the visiting team locker room. The incident report initially said “women’s volleyball locker room” but did not specify which one.

The men’s lacrosse athlete claimed he was at the Al McGuire Center to do laundry, the incident report said. Reporting officer Carolina Seidl said in her report he did not have any laundry with him.

MUPD then arrested and cited him for disorderly conduct and obstructing and resisting an officer. He continued to deny the assertion that he was having sex with the female student before eventually admitting to it.

The arrest came six days before Marquette men’s lacrosse’s loss to Cleveland State, in which head coach Joe Amplo suspended 19 players. It’s unknown whether the arrest was related to the team’s suspensions.

The alleged sexual activity was consensual, the female student involved told MUPD. She drank an unknown amount of vodka, which MUPD confiscated at the scene. She told MUPD she last drank the vodka at 2 a.m., slightly more than an hour before MUPD received the call.

She initially denied having sex with the male student, but changed her answer after Seidl “reminded her to be honest.” Her name was redacted, and the incident report said she lives in Cobeen Hall.

If it was consenual as stated, arresting the student is pretty heavy handed. Sure, suspend him for a couple games or whatever, but bringing the legal process into it seems like overkill.

We were all college students and did some crazy stuff. I never did this, but lots of people did stuff like this across campus. It is what it is, no one is getting hurt. Consenual adults.

This is an example of the heavy handedness of having an MUPD vs Public Safety. Public Safety would have just broken it up and told everyone to go home.

In my time at MU, Public Safety excelled at de-escalation and just getting students home safe. IMO, That should always be the #1 priority.

Given MU's past history around sex-based criminality with regards to student athletes, I'm glad nobody looked the other way on this. I agree that now that the are police versus public safety they have different responsibilities and charters. I'm sure the male in question didn't help by likely escalating. Seems like both parties tried to lie their way out of this so not a great look for either of them.

One other note that should be explored, likely an underage alcohol situation as well if the female in question is from Cobeen. Given the questionable nature of consent after a lot of alcohol, I think this needs to be run through all the right processes.

Sucks that two kids might get in a bad spot over this, but it's the world we live in these days.

I'd agree.  I didn't go to MU for undergrad, but in my college town, it was pretty uniform, if campus police caught you doing something "illegal" but innocuous, provided you were cooperative and polite, you'd get scolded and escorted home or the like.  If it was the town PD, here come the cuffs with quickness.

As a sophomore, a group of us tried to climb onto a campus building (1.5 stories tall)as a dare and also to confirm what we'd heard about what you could see.  Campus police rolled up, at the same time as one of the group was urinating drunkenly on a tree in plain view.  We got a "you guys are acting like complete idiots" talk, a check of our student IDs, and a slow moving cruiser observing our walk back to the dorms at 230AM.

A month later, local PD collared some other friends of mine walking just off campus.  One had stopped to urinate in some bushes.  Cops pulled out, leapt into action, and when the other of the group said "this is bull****", both got cuffed and taken in for disorderly conduct.  The chap with the sensitive bladder had to consult a family friend to avoid a public indecency charge that the police had pushed for.

Right.  But we don't know the context in which the janitor called the police.  Did they know what was going on or just hearing noises and were concerned / frightened?  And really I don't want a janitor at 3AM to be the arbiter of when the cops should be called.

Really important you understand that A) at no point am I saying there could have been rape B) that rape is never something to joke about and C) the 3rd shift janitor is not someone I want determining if an assault is taking place or not.

Get the cops/appropriate authorities involved so that determination can be made. In this case, sounds like it was determined to be consensual, which is great but also not something I want outsource to a witness

If you're working the overnight shift cleaning buildings, that job is probably pretty important to you.  I don't blame him for reporting the incident.  I wish MU would have just sent the kids home...but the janitor, no way should the kids put his livelihood in jeopardy.
