Why was bail set at all?

Well, bad juveniles do bad things, and you need to make sure the parents don't help them disappear.

I think he means why wasn’t he held without bail. I don’t think that’s an option for juveniles in Wisconsin.

I think he meant there should be no bail?

As someone who has spent a lot of time in Chippewa Falls and was married there, this is tough to stomach.  There are a lot of bad people in the world, even in the perceived safest communities.  I’ve heard a few details and this is a messy story.

Ok, correction noted.

But my point doesn't vary much.  $100k is a bit much for families in CF to stomach.  That's about 1/2 the value of their homes.  What are they gonna' do - charter a gulfstream and get him out of there?

Cash bail should be illegal.  Either the person is too dangerous to be in society, or they're not.

Yeah, that is working well in LA, SF and NY where there is essentially no bail.

World sure is a scary place when you've got Fox News, Newsmax and OANN on all day, isn't it?

The jurisprudential theory of cash bail and its intersection with the presumption of innocence is a fun gordian knot that most people prefer to simply cut in half while repeating the magic phrase "tough on crime."

There's a nuanced conversation to be had about why bail exists, how it is used, and what its practical effects are on both those who are arrested and those who are "law-abiding" citizens. Unfortunately, I don't have a lot of faith that a college hoops message board is likely to be the place where it happens.

So you think the Chippewa Falls kid should have had bail set? I'm confused now.

No, bail should have been withheld in this case.

Ask the folks in Waukesha how they feel about that.

I see you're interested in pre-crime!

Meanwhile half a million American citizens sit in a jail cell without conviction simply because they can't afford bail.  It should be illegal.

This causes them to lose employment, housing, or even custody of their children.  Most of the time for minor offenses.

Eliminate cash bonds.  Either you're too dangerous for society, or you're not.
