Title: 2/3rds rules
Post by: real chili 83 on December 13, 2012, 05:53:02 PM
This article on CNNSI is very verbose.  It talks about all of the challenges that lay ahead of the C7. It seemingly ignores the power inherent in 2/3rds.  It does mention it, but imho, does not recognize the power of 2/3rds.

There is an interesting component to this article....how do the ncaa units that are earned by current (and former) BE members, payable in the future, will be divided.

Anyone have any insight on the issue of units?  Sounds like the money could be more significant that the exit fees, BE name, etc.

LW, nice job.  ND still sucks though. ;D

I just saw this as well:

Pete Thamel ‏@SIPeteThamel
Talk of Big East "dissolving" and votes needed is moot. Bylaws say 2 FB schools need to vote for dissolution. The 7 will just leave.

This is the only place I've seen anyone mention this rule, but if true, would make the exit a lot more difficult--shifts the power away from the BE7 to the remaining schools.

Here are the bylaws (starting on page 12 of this PDF ... dissloution section starts on page 25). Don't see anything about needing two football schools to vote for dissolution:

Yeah, my concern (that I also voiced yesterday), is that the bylaws may have been amended since the WVU lawsuit (maybe for precisely this concern).  It seems odd for Thamel to make such a definite claim, unless he had some good info to go off of.  I tweeted at him to find out where that comes from--I'll post if I get a reply.

Agreed.

The CNNSI article was a bit convoluded on this topic.  I suspect.....a little biased to be blunt.

I doubt the heaven 7 are going into this without knowing all of the angles.

This breakup might not be smooth or pretty, but I don't think any of these schools are going to be surprised.

QuoteBut a Big East source told SNY.tv Thursday that the Catholics can't dissolve the league with a two-thirds vote because at least two football and two basketball members must vote to dissolve.
http://zagsblog.com/articles/big-east-source-no-decision-yet/

Looks like a second article that is repeating this.  Either the same source is spreading this, or maybe the bylaws were amended to prevent either the football or basketball teams exercising the "nuclear" option.

Either way, sounding more likely that the BE7 can't dissolve--or threaten it--to get the bulk of the assets.  Instead, will have to play nice and find some way of splitting the assets with the remnants.  Just hope that we get enough of the exit fees, tourney credits, name/brand, MSG contract, etc. to be well on our way.

However, two other reports from Thamel re: bylaws and assets that are also interesting:

Pete Thamel ‏@SIPeteThamel

Couple of relevent Big East bylaw facts. The seven departing school will be able to bring their NCAA units with them. (And the AQ).

The one topic not addresed in the Big East bylaws is the actual Big East name. So that's foggy right now.
