I didn't think any digit over 5 could be worn because the refs can't make any solitary digit over 5 with their hands

They didn't use that rule when jersey numbers first came about.
If you look at the players who wore numbers above 5, you won't recognize many names.

It's the NBA, Kobe never gets fouls called on him. Ref doesn't have to worry about it.
