Title: Could the MU Golden Eagle violate Iowa's patent?

Interesting article.  Apparently the Southern Miss. Golden Eagle violates the University of Iowa's patent on their Hawkeye logo. 

Our Golden Eagle logo is not much different...  At least we are not black and gold I guess.

We'd better off as the "Gold" than the generic "Golden Eagles." Can I sue Marquette on Iowa's behalf?

When we played Southern Miss. a few years ago you could see their golden Eagle looked more menacing. Also, if you read the article closely part of the problem was that Southern Miss and iowa had the same colors. I am pretty sure Iowa is gold and black, while we are gold and blue. Also, Southern Miss. showed the court several other examples of teams using eagles for mascots. You have to assume they showed the court our golden eagle. The court ruled that none of the examples resembled Iowa's. So as much as you might like it to, I think you will find our golden eagle does not violate Iowa's patent.

I think it's funny that they have a problem with this logo 9 YEARS after it came out.

Attached are our logo, and the fathead.com s logo of each of the others, that are the subject of the trademark/servicemark battle (not a patent issue)

...we dont look violative, or  involved...compare the latter 2 (So. Miss./Iowa) to ours

Hmm...I disagree. As far as I can tell, that first logo (Iowa) looks almost identical to ours (#2) except for the colors. Honestly, the third one, Southern Miss, looks more like a rip-off of ours than it does Iowa's.

But then again, they are all so similar that I can hardly tell them apart. That's it, tear up our logo, time to go back to Warriors!

I wasnt clear enough in IDing these, I guess....
The first is not Iowa..

...the attachments are:

1-MU
2-SoMiss
3-Iowa

The TM battle is 2 vs 3, and Bilsu notes, these 2 also share identical team colors-- we dont have a dog in their hunt.

Besides the color difference, Mu's shows an eye when the other two do not. MU actually looks more like a real eagle than a character.

I always thought our eagle logo looked like the Rockford Riverhawks logo.

Which came first?  The chicken or the...eagle?  They definitely have consistent elements to have been ripped from each other.

Chicken hawks have become pretty common mascots and their cartoon logo versions are also going to be pretty similar.  The moron in a hurry test might allow the plaintiff to argue likelihood of confusion between these logos, but I don't think that argument would fly at trial.  Aside from the Fat Head type of stuff, how often are these used without the school's name or some other symbol/logo?  Not that it's indicative of the other schools, but it doesn't seem like MU does it very often.  In closing, bring back the Warriors.

If we have to continue to be the Golden Eagles, I just think we should go back to the old eagle logo. That bird was ferocious
